Welcome to Mighty Moto. These Terms of Service govern your access to and use of our website, products, services, and online store, including the purchase and use of the Holeshot Trainer and any other Mighty Moto products.

By visiting our website, placing an order, creating an account, signing up for updates, or purchasing from us, you agree to these Terms of Service. If you do not agree to these terms, you should not use our website or purchase our products.

For purposes of these Terms, “Mighty Moto,” “we,” “us,” and “our” refer to Mighty Moto and its owners, operators, employees, contractors, and affiliates. “You” and “customer” refer to any person who accesses our website, places an order, purchases a product, or uses our products.

1. Use of Our Website

You agree to use our website only for lawful purposes and in accordance with these Terms. You may not use our website to:

• Violate any applicable law, regulation, or third-party right;
• Attempt to interfere with the security or operation of the website;
• Submit false, misleading, or fraudulent information;
• Use automated systems, bots, scraping tools, or similar methods without our written permission;
• Copy, reproduce, or exploit any portion of the website or its content without authorization.

We reserve the right to refuse service, cancel orders, suspend access, or remove content at our discretion if we believe these Terms have been violated.

2. Product Information

We make reasonable efforts to display product descriptions, specifications, pricing, images, and availability accurately. However, we do not guarantee that all product information on the website is complete, current, or error-free.

Product images, renderings, descriptions, packaging, colors, features, materials, and specifications may vary from the final product. We reserve the right to update, modify, improve, discontinue, or change any product at any time without prior notice, provided that such changes do not materially reduce the core functionality of a product already purchased.

The Holeshot Trainer is a reaction-time training device intended to help users practice launch timing and hand-control reaction in a controlled environment. It is not a safety device, medical device, racing certification device, or substitute for professional instruction, rider training, parental supervision, or safe riding practices.

3. Pre-Orders

Certain products may be offered for pre-order before they are in stock or ready to ship. By placing a pre-order, you acknowledge and agree that:

• You are purchasing a product that may not ship immediately;
• Estimated shipping dates are estimates only and are not guaranteed;
• Production, manufacturing, supply chain, quality control, customs, shipping, or other delays may occur;
• Your payment may be charged at the time your order is placed;
• Pre-order availability, edition numbers, packaging, features, or delivery timing may be subject to change.

For Launch Edition products, edition numbers may be assigned based on production, fulfillment, or order-processing sequence at our discretion. Placing an order does not guarantee a specific serial number unless expressly stated in writing by Mighty Moto.

If a pre-order is delayed, we may notify you using the contact information provided at checkout. Your cancellation and refund rights are governed by our Refund Policy and applicable law.

4. Orders, Acceptance, and Cancellation

Placing an order does not guarantee acceptance of the order. We reserve the right to accept, decline, limit, or cancel any order for any reason, including but not limited to:

• Product availability;
• Suspected fraud or unauthorized payment activity;
• Incorrect pricing or product information;
• Shipping restrictions;
• Compliance concerns;
• Resale or bulk purchasing concerns;
• Errors in customer information;
• Orders placed from regions where we are unable or unwilling to ship.

If we cancel an order after payment has been processed, we will issue a refund to the original payment method unless otherwise required by law.

You are responsible for ensuring that your shipping address, billing information, email address, phone number, and order details are accurate before submitting your order. Mighty Moto is not responsible for delays, failed deliveries, or additional costs caused by inaccurate or incomplete information provided by you.

5. Pricing and Payment

All prices are listed in U.S. dollars unless otherwise stated. Prices are subject to change at any time without notice.

We reserve the right to correct pricing errors, typographical errors, product errors, or promotional errors. If an order is placed with an incorrect price or incorrect product information, we may cancel the order and issue a refund.

Payment must be made through the payment methods offered at checkout. By submitting payment information, you represent that you are authorized to use the selected payment method and authorize us or our payment processors to charge the total amount of your order, including product price, taxes, shipping, and applicable fees.

We do not store full payment card information. Payment processing is handled by third-party payment processors.

6. Shipping and Delivery

Shipping timelines, rates, carriers, and delivery estimates are described in our Shipping Policy and during checkout when applicable.

Delivery dates are estimates only and are not guaranteed unless expressly stated in writing. Mighty Moto is not responsible for delays caused by carriers, customs, weather, incorrect addresses, supply chain issues, or events outside our reasonable control.

Risk of loss passes to you when the product is delivered to the shipping address provided at checkout, unless otherwise required by applicable law.

If a package is marked as delivered by the carrier but you did not receive it, you are responsible for contacting the carrier and notifying us promptly so we can assist where possible. We do not guarantee replacement or refund for packages marked delivered.

7. International Orders

If we accept orders outside the United States, you are responsible for complying with all laws, regulations, import rules, customs requirements, taxes, duties, VAT, brokerage fees, and other charges that may apply in your country.

International customers acknowledge that:

• Product availability may vary by country;
• Certain products may not be certified, approved, or compliant for sale or use in every region;
• Mighty Moto may cancel or refund orders that we determine cannot be shipped or fulfilled due to legal, regulatory, customs, carrier, or compliance concerns;
• Import duties, VAT, customs fees, brokerage charges, and similar costs are the customer’s responsibility unless expressly stated otherwise at checkout.

We make no representation that our products or website are appropriate, available, certified, or lawful for use in every country.

8. Returns, Refunds, and Exchanges

Returns, refunds, exchanges, cancellations, and damaged item claims are governed by our Refund Policy and Return Policy.

Unless otherwise stated in that policy, shipping charges may be non-refundable, and customers may be responsible for return shipping costs.

Products that are used, damaged, modified, abused, exposed to water, altered, disassembled, or returned without required packaging or authorization may be refused, partially refunded, or ineligible for refund.

9. Product Safety and User Responsibility

You are responsible for using Mighty Moto products safely, responsibly, and only as intended.

The Holeshot Trainer and related products should be used only in a safe, controlled environment away from moving vehicles, motorcycles, bicycles, ATVs, equipment, traffic, obstacles, and other hazards. Do not use the Holeshot Trainer while operating or riding a motorcycle, ATV, bicycle, vehicle, or other moving equipment.

You agree that:

• Motorsports and motocross are inherently dangerous activities;
• Reaction-time training does not eliminate risk;
• Product use does not guarantee improved performance, safer riding, race results, or reduced risk of injury;
• Adult supervision is required when used by minors;
• Users should inspect the product before use;
• Users should discontinue use if the product appears damaged, defective, overheated, swollen, cracked, wet, or otherwise unsafe;
• Users should follow all warnings, instructions, and safety information provided with the product.

To the fullest extent permitted by law, Mighty Moto is not responsible for injury, death, property damage, race results, training outcomes, or other damages resulting from misuse, unsafe use, failure to follow instructions, modification, improper storage, or use outside the intended purpose of the product.

10. Battery and Electronics Safety

Some Mighty Moto products may contain rechargeable batteries, electronic components, wiring, displays, charging circuits, or similar components.

You agree to use and store electronic products responsibly. Do not:

• Expose the product to water, excessive moisture, fire, extreme heat, freezing temperatures, crushing, puncturing, impact, or abuse;
• Charge the product unattended for extended periods;
• Use an incompatible charger or damaged cable;
• Disassemble, modify, short-circuit, puncture, or tamper with the battery or electronics;
• Continue using the product if you notice swelling, smoke, odor, excessive heat, leakage, damage, or malfunction.

Mighty Moto is not responsible for damage or injury caused by improper charging, storage, modification, misuse, unauthorized repair, or failure to follow battery and electronics safety instructions.

11. Limited Warranty

Any product warranty offered by Mighty Moto is described in our Warranty Policy. Unless expressly stated otherwise, our products are provided with only the warranty described in that policy.

To the fullest extent permitted by law, we disclaim all other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, durability, title, and non-infringement.

Warranty coverage does not apply to damage caused by misuse, abuse, accidents, water exposure, improper charging, modification, unauthorized repair, normal wear and tear, cosmetic damage, or use outside the product’s intended purpose.

12. No Performance Guarantee

Mighty Moto products are training tools. We do not guarantee any specific results, including improved reaction time, race performance, gate starts, holeshots, lap times, rankings, safety outcomes, or competitive results.

Testimonials, social media posts, examples, demonstrations, and user experiences are not guarantees that you will achieve the same or similar results.

13. Intellectual Property

All content on our website and products, including but not limited to the Mighty Moto name, Holeshot Trainer name, logos, graphics, product designs, text, images, videos, renderings, packaging, software, firmware, user interface, artwork, and related materials are owned by Mighty Moto or used with permission.

You may not copy, reproduce, modify, distribute, display, reverse engineer, sell, resell, create derivative works from, or exploit any of our intellectual property without our prior written permission.

Purchasing a product does not transfer any intellectual property rights to you.

14. Software and Firmware

Some products may include embedded software, firmware, or digital functionality. Mighty Moto retains all rights in any software or firmware included with our products.

You may not copy, modify, reverse engineer, decompile, extract, redistribute, bypass, or tamper with product software or firmware except as expressly permitted by law.

We may release updates, improvements, or changes to software or firmware at our discretion. We are not required to provide updates, upgrades, modifications, or continued support unless expressly stated in writing.

15. User Content, Reviews, and Submissions

If you submit reviews, photos, videos, testimonials, feedback, comments, social media tags, product ideas, suggestions, or other content to Mighty Moto, you grant us a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, display, distribute, edit, publish, and share that content for marketing, advertising, product development, and business purposes.

You represent that any content you submit is accurate, lawful, original to you, and does not violate the rights of any third party.

We may remove, edit, or refuse to publish user content at our discretion.

Do not submit confidential product ideas, invention concepts, business ideas, or proprietary information unless you have a separate written agreement with us. We are not obligated to compensate you for unsolicited ideas, feedback, or suggestions.

16. SMS, Email, and Marketing Communications

By providing your email address or phone number, you may have the option to receive marketing messages, order updates, pre-order updates, launch announcements, or other communications from Mighty Moto.

You may unsubscribe from marketing emails using the unsubscribe link included in those emails. You may opt out of SMS messages by replying STOP, where applicable.

Transactional messages related to your order may still be sent even if you opt out of marketing messages.

SMS communications may be subject to additional Mobile Messaging Terms.

17. Third-Party Services and Links

Our website may use or link to third-party platforms and services, including but not limited to Shopify, payment processors, shipping carriers, analytics providers, marketing platforms, social media platforms, and embedded content providers.

We are not responsible for the content, policies, security, accuracy, availability, or practices of third-party websites or services. Your use of third-party services may be governed by their own terms and privacy policies.

18. Prohibited Resale and Commercial Use

Unless authorized by Mighty Moto in writing, our products are sold for personal use only and may not be purchased for unauthorized resale, distribution, duplication, copying, reverse engineering, or commercial exploitation.

We reserve the right to limit quantities, cancel suspicious orders, refuse service, or restrict sales to any person or entity we believe may be purchasing for unauthorized resale or misuse.

19. Limitation of Liability

To the fullest extent permitted by law, Mighty Moto and its owners, operators, employees, contractors, suppliers, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to lost profits, lost revenue, loss of data, loss of business opportunity, personal injury, property damage, race losses, training losses, or replacement costs arising from or related to your use of our website, products, or services.

To the fullest extent permitted by law, our total liability for any claim arising from or related to a product, order, website use, or these Terms will not exceed the amount you paid to Mighty Moto for the specific product giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

20. Indemnification

You agree to indemnify, defend, and hold harmless Mighty Moto and its owners, operators, employees, contractors, suppliers, and affiliates from and against any claims, damages, losses, liabilities, costs, expenses, or fees, including reasonable attorney fees, arising out of or related to:

• Your misuse of our products;
• Your violation of these Terms;
• Your violation of any law or third-party right;
• Your unsafe use, modification, resale, or unauthorized repair of a product;
• Your content, submissions, reviews, photos, videos, or feedback;
• Your use of our website or products outside their intended purpose.

21. Force Majeure

Mighty Moto will not be liable for delays or failures caused by events outside our reasonable control, including but not limited to supply chain disruptions, manufacturing delays, labor shortages, carrier delays, customs delays, natural disasters, severe weather, fire, flood, war, terrorism, civil unrest, pandemics, government actions, power outages, internet failures, material shortages, or supplier issues.

22. Governing Law

These Terms and any disputes arising from or related to them, our website, our products, or any order placed with Mighty Moto will be governed by the laws of the State of Indiana, without regard to conflict-of-law principles.

23. Dispute Resolution

Before filing any legal claim, you agree to first contact Mighty Moto and attempt to resolve the dispute informally. You may contact us at:

If a dispute cannot be resolved informally, any legal action shall be brought in the state or federal courts located in Indiana, unless otherwise required by applicable law.

You agree that any claim must be brought on an individual basis and not as a class action, collective action, or representative action to the fullest extent permitted by law.

24. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.

25. No Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision. Any waiver must be in writing and signed by Mighty Moto.

26. Changes to These Terms

We may update or modify these Terms at any time. Changes will be effective when posted on our website, unless otherwise stated.

Your continued use of our website or purchase of products after changes are posted means you accept the updated Terms.
